So, so you distinguish, I mean, you could say insurance is a risk is if you get a guarantee warranty or something from, from manufacturer that's not insurance. It's got to be somebody else that, take undertakes the risk. The law is, is the relationship between the person
00:00:35 - and the insurer who's giving the insurance. so that's a contract of insurance and it's governed by contract law and the particular aspects of insurance that differ from sometimes from general contract law. so that's that. Yeah. And also you've got a body of law which says who can be insurers, what they have to go through. 'cause that's closely regulated and has been for many, many years in this country.
00:01:08 - there are traces of it a long time ago, but, but it was in Italy that in Europe it seems that first of all, the concept of insurance was developed and it basically involved merchants agreeing in the, in amongst themselves to bear the risk for each other of the ships, the boats and the cargo on the boats being lost at sea.

00:06:25 - to accept a proportion of the risk. And so it goes, underwriter one say says, okay, yeah, this looks all right for a premium of so much, I will take 10% of the risk and so on and so on. So the broker goes round the market until hopefully they've got a hundred percent of the risk covered. The risk was 50 million pounds and they've managed to achieve that.
00:06:58 - one or two underwriters or three underwriters, four hundreds say fine, okay, but you haven't got anywhere near a hundred percent. And the person who wants to be insured says, well, I don't want this. I only want a hundred percent. I don't want 50% or 70%. I want a hundred percent. And it rose in the case, a few years back now actually as to whether there was a contract with each individual underwriter.
00:07:31 - and signed scratched their name or whether it was complete only when there was the a hundred percent cover and the court of appeal said, well, the practice of the Lloyd's market has long been that an individual underwriter is bound by as soon as they have signed up for the scheme. And we are going to say that that is actually the law

It may not be for a hundred percent, but each of the underwriters who has accepted the proposal they've made is bound and they are bound to that extent. It has regulatory powers and so on.
