Traditional descriptions of judicial dissent focus on transparency, opposition, and conscience, according to research. These accounts don’t fully explain how dissent affects institutional authority. This article adds a ritual theory analysis of dissent to current descriptions. This research offers a distinct view of judicial dissent by focusing on form.
